CUSTOMER RESPONSIBILITY STATEMENT
Pharmacy Affiliate Programs is an internet platform for EU-pharmacies to offer their products. Pharmacy Affiliate Programs is only acting as a broker. The products are sold and distributed by the pharmacists without any legal obligation of Pharmacy Affiliate Programs.
The pharmacists offering their products on Pharmacy Affiliate Programs may supply prescription medicines only on the basis of a prescription written by a medical doctor registered in the European Union.
Pharmacy Affiliate Programs cannot held liable in connection with any order placed on its website, especially it cannot held liable for the accuracy of the diagnosis, treatment or medication prescribed or the correct use of the products supplied. It is in the full responsibility of the purchaser to use any products supplied under the guidance of a physician.
Pharmacy Affiliate Programs is only providing the customer's offer to the pharmacists and can therefore not held liable that the correct product, in the correct amount and the correct strength is supplied to the correct customer. The product liability lies exclusively with the manufacturer.
Pharmacists offering their products on Pharmacy Affiliate Programs dispense branded or in the case the patent has expired, generic pharmaceutical products that are registered in EU-member states. European patent law applies.
Pharmacy Affiliate Programs takes no responsibility for compliance with importation requirements and regulations of the country of destination of the products. This remains the final responsibility of the purchaser. For USA-clients a Personal Importation Form based on FDA Chapter 9 guidance for per-sonal importations of drugs will be filed on behalf of the purchaser.
Sale and delivery of all ordered products is in the full and exclusive responsibility of a licensed EU-pharmacy. All products are shipped on behalf of and at the risk of the purchaser and at the agreement of holding Pharmacy Affiliate Programs reserved towards any legal action which might be brought against the purchaser, if not acting in accordance with the regulations and importation laws applied by the government of the country of destination.
All shipments are provided by registered mail or courier and delivery can only be accepted by a person of full age according to the laws of the recipients country. Pharmacy Affiliate Programs cannot held liable for losses, incorrect or delayed deliveries or product damage independent of its cause, especially damages caused of improper handling of the shipping agent.
After shipment of the product, especially after delivery, no return, alteration or refund is accepted.
Fulfillment to the contract is, when the goods leave the pharmacy.
Pharmacy Affiliate Programs as domain is domicilated in Switzerland, therefore Swiss law applies on all disputes with Pharmacy Affiliate Programs.
